I have been the constant, 24/7, live-in caregiver of my mother in her home (the family home) for over 25 years. Can I be evicted from the home upon her death? Her living trust and will stipulate that I have four months to move. She died last month at 103, (long living because of my care).

Maybe consult with a lawyer. You can basically challenge anything you want if the lawyer thinks you have a case

Wow, am I ever sorry to hear this.
Up on the park bench not so very long ago I hear the saddest story from an elderly gay man who was with his partner for 50 years, and cared for him the last 10 of those. Yet the Trust went to the Catholic Church, and he had 6 months to vacate the home.

This can happen when, during a time of long caregiving, a child doesn't get his/her own life, own living space, own family, own job. We have seen it before and have had to tell the child left to move to a shelter, work up to renting a room in someone's home, from there try to get a small efficiency apartment.

It is too late when you come to this circumstance. I WOULD now see an elder law attorney for one hour of time to try to see if there is ANYTHING that can be done retroactively, but that I know of there is not. I hope for your sake that there is SOMETHING. I cannot even imagine where you are now in terms of SS funds? Can you draw SS check for past working at all?

I am so very sorry. Your post here serves as a dire warning to others, as we daily have people come to the forum to ask how they can get paid for caring for their own elders. This often ends badly. I am sorry for your loss, but at 103 your mom had a long life, and much of it without thought to what might be the outcome here for you. I am so very sorry.

I am puzzled by your posting.

First of all, I am sorry for your loss.

You already know the answer to this question. Her will states that you must leave the home.

Do you not have any other place to live? Did your mom pay for your services as her caregiver? Did you take on this responsibility in order to gain a house after she died? Were you her POA? Do you have siblings? Who has inherited the house? Are you planning on contesting the will?

Please don’t be offended by my questions. I am only trying to gather information so that we can better assess your situation.
